Privacy Policy

Last updated: 30 October 2026

This privacy policy explains which personal data we process when you visit our website and use our services, why we do so, and what rights you have. We comply with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

1. Controller

SMART DEPART GmbH Bahnhofstrasse 25 8703 Erlenbach ZH Switzerland Email: info@smart-depart.com

For any questions about data protection, please contact us at this address.

2. Visiting our website and hosting

Our website is hosted by Squarespace (Squarespace Ireland Limited, Dublin, Ireland; parent company Squarespace Inc., USA). When you visit the website, technical data is collected automatically, such as your IP address, date and time of access, pages viewed, browser and operating system. This data is needed to run the website securely and reliably. The legal basis under the GDPR is our legitimate interest (Art. 6(1)(f) GDPR).

3. Cookies

Our website uses cookies. These are small files stored by your browser. Essential cookies make sure the website works. We also use cookies to measure website usage (see section 7). You can delete or block cookies in your browser settings at any time. Some features of the website may then be limited.

4. Contact form and email

If you contact us via the contact form or by email, we process your first and last name, email address, phone number, subject and message in order to respond to your enquiry. Form data is transmitted and stored via Squarespace. The legal basis under the GDPR is the preparation or performance of a contract, or our legitimate interest in answering enquiries (Art. 6(1)(b) and (f) GDPR).

5. Appointment booking via Calendly

We use Calendly (Calendly LLC, USA) for booking consultation appointments. When you book an appointment, your name, email address, chosen time slot and any details entered in the booking form are transmitted to Calendly. Calendly may also collect technical data such as your IP address. The data may be processed in the USA. The legal basis under the GDPR is the preparation of a contract (Art. 6(1)(b) GDPR). More information: https://calendly.com/privacy

6. Newsletter via Brevo

You can subscribe to our newsletter on our website. We use it to keep you informed about current apartment listings and news from SMART DEPART. To subscribe, we only need your email address.

Subscription uses a double opt-in process. After signing up, you will receive an email with a confirmation link. You are only added to our mailing list once you confirm. We store the time of sign-up and confirmation, as well as your IP address, so that we can prove your subscription.

The newsletter is sent via Brevo (Brevo GmbH, Köpenicker Strasse 126, 10179 Berlin, Germany). Your data is stored within the EU. Brevo tracks whether a newsletter was opened and which links were clicked. We use this information to improve our newsletter.

Processing is based on your consent (Art. 6(1)(a) GDPR). You can unsubscribe at any time, either via the unsubscribe link in every email or by writing to info@smart-depart.com. We will then remove your email address from our mailing list. More information: https://www.brevo.com/en/legal/privacypolicy/

7. Google Analytics

We use Google Analytics 4 (Google Ireland Limited, Dublin, Ireland; parent company Google LLC, USA) to understand how visitors use our website. Google Analytics uses cookies and collects information such as pages viewed, time spent on the site, where visits come from, device type and approximate location. Google Analytics 4 does not store IP addresses. The data may be processed in the USA. The legal basis under the GDPR is our legitimate interest in improving our website (Art. 6(1)(f) GDPR). You can prevent data collection with Google's browser add-on: https://tools.google.com/dlpage/gaoptout

8. Google Ads

If we run advertising campaigns via Google Ads, Google conversion tracking may be used on our website. It records whether someone takes a specific action after clicking an ad, for example sending an enquiry. We only receive aggregated statistics, not data that identifies you personally. The provider is Google (see section 7). The legal basis under the GDPR is our legitimate interest in measuring the success of our advertising (Art. 6(1)(f) GDPR).

9. Google reviews

Our website displays public reviews from our Google Business Profile. These include the name or profile picture that the reviewer published on Google. The reviews are displayed via the service Elfsight. When the reviews load, technical data such as your IP address may be transmitted to this service and to Google. If you are a reviewer and no longer wish to be displayed, you can edit or delete your review on Google or contact us.

10. Apartment search via Heimster

Our apartment listings and the search form are embedded via the Heimster service. When you use the search or open a listing, technical data such as your IP address is transmitted to Heimster. Any details you enter in a form there are sent to Heimster and to us so that we can process your enquiry.

11. Links to social networks

Our website links to our profiles on Facebook, Instagram and LinkedIn. These are simple links. Data is only transmitted when you click a link and visit the respective platform. The privacy policy of that provider then applies.

12. Transfers abroad

Some of the service providers mentioned process data in the EU or the USA. The EU is considered to provide adequate data protection. For the USA, we rely on the Swiss-U.S. or EU-U.S. Data Privacy Framework where the provider is certified, or on standard contractual clauses.

13. Retention

We only keep personal data for as long as necessary for the respective purpose or as required by statutory retention obligations. Enquiries that do not lead to a contract are generally deleted after two years at the latest.

14. Your rights

You have the right to request information about the personal data we hold about you. You may also request its correction, deletion or release, and object to its processing. You can withdraw any consent you have given at any time. To do so, please contact info@smart-depart.com. You also have the right to lodge a complaint with a data protection authority; in Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC).

15. Changes

We may update this privacy policy at any time. The version published on our website applies.
